Rules and Regulations for the State of Kansas

Sales Tax Law:

HB 2140, effective July 1, 2019. HB 2140 exempts “all sales of gold or silver coins; and palladium, platinum, gold or silver bullion.”

The measure continues, “For the purposes of this subsection, “bullion” means bars, ingots, or commemorative medallions of gold, silver, platinum, palladium, or a combination thereof, for which the value of the metal depends on its content and not the form.”

NPMEX is required to collect tax on some items shipping to Kansas, however sales tax will not be charged for Gold or Silver Coins, or Gold, Silver, Platinum, or Palladium bullion items as they are exempt from sales tax when shipping to a Kansas address.

The State of Kansas requires the collection of sales taxes on certain products sold by NPMEX and delivered to a Kansas address. These taxes must be collected on (1) any coins that are not gold or silver; (2) copper products; (3) accessory items; and (4) processed items. All other products sold by NPMEX are exempt from these taxes.

The following definitions apply to products on which taxes must be collected in Kansas:

  • Bullion: Bars, ingots or commemorative medallions of gold, silver, platinum, palladium, or a combination thereof, for which the value of the metal depends on its content and not the form.
  • Accessory Items: Items such as holders, tubes, coin flips, and gloves.
  • Processed Items: Precious metals that have been processed by third parties into items that are valued on more than their precious metal content, such as statues or colorized coins.

Sales taxes in Kansas are calculated at checkout on the NPMEX.COM website based on (1) the taxability of products sold by NPMEX in Kansas set forth above, and (2) the specific tax rates established by the taxing jurisdiction of the delivery address in Kansas.

Capital Gains Tax:

Under current law, gold and silver are subject to capital gains taxation when exchanged for Federal Reserve notes or when used in barter transactions.
